Tryotic Terms of Service

Welcome to Tryotic! These Terms of Service ("Terms") govern your access to and use of the Tryotic iOS application and related services ("Tryotic" or the "Service"), provided by AtikoLabs ("AtikoLabs", "we", "us" or "our"). By downloading or using Tryotic, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service. We may also present additional guidelines, rules, or terms for specific features (for example, promotional campaigns or new functionality); those additional terms become part of these Terms, and by using that feature you agree to them as well.

Please read these Terms carefully. They include important information about your responsibilities when using Tryotic, our limitations of liability, your rights regarding content, and other key topics. If you have any questions, feel free to contact us at any time.

1. Eligibility and Accounts

Minimum Age: Tryotic is not for use by anyone under the age of 16. By creating an account or using the Service, you affirm that you are at least 16 years old. If you are 16 or older but still a minor in your jurisdiction (for example, under 18 in many countries), you must have your parent or legal guardian's permission to use Tryotic, and they must review and agree to these Terms on your behalf. We reserve the right to ask for proof of age or parental consent if necessary. If we discover that a user under 16 is using the Service, we will terminate the account.

Account Registration: To use certain features of Tryotic (such as generating images beyond a trial), you need to create an account. You can register by providing an email and password, or by using third-party login options like Google Sign-In or Sign in with Apple. You agree to provide truthful, current, and complete information during registration and to keep it updated (e.g., if your email address changes).

Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for restricting access to your device. You are solely responsible for all activities that occur under your account. If you suspect any unauthorized use of your account or any other breach of security, you must notify us immediately. We encourage you to use a strong password and to log out when finished, especially if using a shared device. AtikoLabs will not be liable for any loss or damage arising from your failure to safeguard your account.

Third-Party Accounts: If you register or log in through Google or Apple, you are also subject to those providers' terms and conditions. You must ensure that you comply with any requirements of your Google/Apple account (for instance, App Store terms if applicable). We are not responsible for any issues arising from your use of third-party authentication.

Account Ownership: Your account is personal to you. You may not sell, transfer, or share your account credentials with another person or impersonate someone else. You agree that the information you provide to us is accurate and that you have no intention to create an account for anyone other than yourself. We reserve the right to suspend or terminate accounts that use false information or that appear to be used by multiple people or for fraudulent purposes.

2. User Responsibilities and Acceptable Use

By using Tryotic, you agree to use the Service only for lawful purposes and in compliance with these Terms. You must not misuse Tryotic or help anyone else to do so. Specifically, you agree that you will NOT:

• Illegal Purposes: Use our Service for any illegal or unauthorized purpose. You must comply with all applicable laws, regulations, and ordinances in your jurisdiction when using Tryotic.
• Prohibited Content: Upload, create, generate, or share any content via Tryotic that is illegal, objectionable, or infringes on others' rights. This includes (but is not limited to) content that is:
  • Pornographic, obscene, or sexually explicit.
  • Unlawful, hateful, or discriminatory – for example, content that promotes racism, bigotry, hatred, or harm against any group or individual.
  • Violent or graphic content that incites harm or is overly gory.
  • Defamatory or harassing – content that defames, stalks, harasses, bullies, or threatens others.
  • Invasive of someone's privacy or personal data – for instance, uploading images of people without their consent, especially in private settings.
  • Infringing on any intellectual property or proprietary rights of others, including copyright, trademark, or trade secret. Do not upload images of artwork, logos, or products that you do not have the right to use. You must not upload content that violates any applicable local, state, national or international law or regulation.
  • Encouraging or depicting dangerous or illegal activities (e.g., criminal behavior, drug use).
• Impersonation and Fraud: You will not impersonate any person or entity or misrepresent your affiliation with anyone. You will not engage in fraud or attempted fraud (for example, attempting to use a stolen credit card, or tricking the AI to produce disallowed content).
• Security Interference: Attempt to probe, scan, or test the vulnerability of our Service or any related system or network. You must not hack, decrypt, decompile, or reverse engineer any aspect of Tryotic. Also, do not transmit any worms, viruses, or harmful code that could damage or interfere with our app or with other users' devices.
• Unauthorized Access: Access or attempt to access any account or data that is not yours. This includes not using another user's account without permission or bypassing any security measures.
• Spam and Abuse: You agree not to use Tryotic to spam others or for any abusive purposes. This means you will not use the service to send unsolicited advertising, promotional materials, or repetitive messages. You will not use any automated system (like bots, scripts, or scrapers) to send more requests to the Service than a human could reasonably produce, nor will you attempt to overload or disrupt the Service (e.g., a denial-of-service attack).
• Interference with Others: Do not engage in any activity that interferes with or disrupts the access, enjoyment, or use of the Service by others. This includes trolling, flaming, or any behavior that materially detracts from other users' experience.
• Circumventing Limits: Use Tryotic only through our provided interface. Do not attempt to circumvent any usage limits, quotas, or fees. For example, if your account has a credit limit or if certain features are behind a premium membership, you agree not to hack or work around those restrictions.

AtikoLabs reserves the right to monitor content submitted to Tryotic and your usage of the Service to ensure it complies with these Terms (however, we do not guarantee we review all user content). We may remove or disable any content that violates these rules, and we may suspend or terminate accounts engaged in prohibited activities. We are not responsible for content that users upload; however, if you see any misuse of the Service or content that you believe violates these Terms, please report it to us.

3. User Content and Intellectual Property Rights

3.1 Your Content

Ownership: You retain ownership of all content that you upload to Tryotic, including the photos of products or fashion items you provide, as well as the AI-generated images that are produced for you. We do not claim any ownership rights over your uploaded designs, images, or other content. They remain yours.

License to Us: In order to operate the Service, you grant AtikoLabs a non-exclusive, worldwide, royalty-free license to use, host, reproduce, modify, adapt, transmit, display, and create derivative works from your content solely for the purpose of providing and improving the Tryotic service. This means, for example, we have your permission to store your photos on our servers, send them to our AI model to generate new images (which is a form of creating a derivative work), display the outputs to you, and make backup copies for safety. We will not use your content for any purposes outside the scope of providing the service without obtaining your explicit consent. This license is necessary for us to run Tryotic, and it ends when you delete your content or terminate your account. Specifically, if you remove a particular photo from Tryotic (or delete your account entirely), we will stop using that content and delete it from our active systems within a reasonable time, as described in the Privacy Policy. (Be aware that removed content might persist in temporary backups for a short period, but it will be removed according to our retention practices.)

Your Responsibilities for Content: You represent and warrant that you have all necessary rights to upload the content you submit to Tryotic and to grant the license above. In other words, you promise that by uploading a photo, you either own it or have permission from the owner, and that our use of it per these Terms will not violate any third-party rights. For example, if you upload a photograph of a clothing item, you should either own that photo or have the photographer's permission; if the photo includes a brand logo or another person, you should have the rights or consent needed. You also agree that such content is lawful and not in violation of the Acceptable Use rules in Section 2. You remain solely responsible for your content. AtikoLabs is not responsible for any content that you upload or the images generated from it, nor any consequences of you sharing that content outside our Service.

We reserve the right (but have no obligation) to remove or disable access to any user content for any reason, including content that we believe violates these Terms or that we deem objectionable. We may do this at our sole discretion, although we do not review all content. We may also terminate or suspend your account for serious or repeated violations. However, AtikoLabs is not obligated to pre-screen or monitor your content, and you acknowledge that you may be exposed to content from others that you find offensive or inappropriate. If so, you can report it to us, but your use of the Service is at your own risk.

Feedback: If you provide us with any suggestions, ideas, or feedback about Tryotic ("feedback"), you agree that we can use, implement, and modify such feedback without restriction or compensation to you. You are not obligated to provide feedback, but we appreciate it as it can help improve the Service.

3.2 Generated Content

One of Tryotic's core features is generating stylized images of fashion items using AI.

Ownership of Outputs: To the extent possible under applicable law, the rights to the AI-generated images are granted to you as the user. We want you to be able to use the images you create through Tryotic freely – for example, you can download them, post them on social media, use them in your store or lookbook, etc. AtikoLabs will not claim copyright or ownership of the images we generate for you, and you are free to use or even modify those images as you see fit. Keep in mind, the outputs are based on the content you provide; if your input was infringing or unlawful, the output might be as well – so ensure your inputs are appropriate. Also, note that copyright laws around AI-generated content can be complex or evolving; our intention is that you have the benefit of the images, but we cannot guarantee how courts or laws might treat AI-produced images. Regardless, we disclaim any ownership interest in your outputs and will not reuse them except as allowed under "License to Us" above (which is primarily for storing and processing them for you). And as Botika (a similar service) assures, you own every image you create with our app, with no ongoing licensing fees or claims from us.

Your Use of Outputs: Because you own the generated images, you may use them for personal or commercial purposes, subject to this section and applicable law. For example, you can place the generated photos on your website, social media, marketing materials, or even print them. However, you should not imply that the images were created by a human model or photographer if that's misleading; it may be prudent to clarify they are AI-generated in contexts where honesty is required (such as advertising standards – this is up to you). Additionally, you agree not to use the outputs in a way that violates any person's rights or any law. If an output accidentally resembles a real person or includes something that looks trademarked (which shouldn't typically happen given our model's design, but just in case), you should refrain from using it in a manner that would infringe on those rights.

3.3 Our Intellectual Property

Apart from your content, all other materials and content in Tryotic are owned by AtikoLabs or our licensors. This includes the software, code, design, the AI models and algorithms (licensed via third parties), text, graphics, logos, and trademarks associated with Tryotic ("AtikoLabs IP"). Tryotic and all Services provided are protected by copyright, trademark, and other intellectual property laws. We remain the sole owner (or authorized licensee) of all right, title, and interest in and to the Service and Atiko Labs IP. Nothing in these Terms grants you any ownership rights in our IP. We only grant you a limited, revocable license to use Tryotic for its intended purpose as outlined in these Terms. You shall not copy, distribute, modify, or create derivative works from our app or any of our intellectual property without our prior written consent. All trademarks, logos, and service marks displayed in Tryotic are our property (or the property of third-party owners). You are not permitted to use these marks without our prior written consent.

If you happen to download any software from us (like an update that's not through the app store), we grant you a personal, non-transferable, non-exclusive license to use the software solely to access the Service, and only in accordance with these Terms. You agree not to reproduce, reverse-engineer, or alter any of our software.

4. Purchases, Credits, and Payment Terms

Tryotic may offer both free and paid features. Some advanced features (such as generating a large number of images or using high-resolution outputs) might require you to purchase credits or subscribe to a premium membership plan. This section explains how our payment and credit system works and your rights and responsibilities when making purchases.

Credits: Tryotic uses a credit system for AI image generation. A "credit" represents the unit needed to generate an image (for example, one credit may allow you to generate one new stylized photo). We will inform you in the app how many credits are required per generation or per feature. You can acquire credits either by purchasing them as one-time packages or by subscribing to a plan that includes a monthly credit allowance. The price of credits and the details of plans (such as how many credits per month) will be displayed in the app at the time of purchase. Credits have no monetary value outside Tryotic and cannot be exchanged for cash; they are merely a measurement of service usage. Credits may be personal to your account and typically cannot be transferred to other users unless we explicitly allow it.

Purchases and Billing: If you choose to buy credits or subscribe to a premium membership, you agree to pay the indicated fees.

Payment Method: We accept major credit and debit cards (e.g., Visa, MasterCard, American Express) and possibly other payment methods (such as Apple in-app purchases or PayPal) as indicated. By providing a payment method, you represent that you are authorized to use that method and that you authorize us (or our third-party payment processor) to charge the full amount of the purchase (including any applicable taxes) to that payment method. We may store your payment method details via our secure payment processor for the purpose of billing you for subscription renewals (if applicable).

Premium Membership (Subscription): If you enroll in a subscription, it will typically auto-renew at the end of each billing cycle (e.g., monthly or annually) by charging your payment method on file, until you cancel. We will inform you of the renewal dates and rates when you subscribe. You can cancel a subscription at any time, but cancellations take effect at the end of the current billing period. This means if you cancel, you will not be billed again going forward, but you will retain the premium benefits (and remaining credits) until the current paid period expires. After cancellation, or if a renewal charge fails, your premium features will revert to the free level at the period's end. To cancel a subscription made through the App Store, you must follow Apple's cancellation procedures (typically via your device's Settings > Subscriptions). If you subscribed through our website or another method, you can cancel through the provided interface or by contacting our support.

No Refund Policy: All purchases of credits and subscription fees are final and non-refundable. We do not offer refunds or credits for any unused credits, partial subscription periods, or unwatched content, except where required by law. For example, if you purchase a pack of 100 credits and only use 50, we typically will not refund the remaining unused credits. Similarly, if you cancel a subscription in the middle of a month, you will not receive a refund for the remaining days; you will retain access until the end of that period as stated, but no pro-rated refund. We reserve the right to consider refund requests on a case-by-case basis in exceptional circumstances (e.g., a technical issue on our side that prevented you from using the service after a purchase), but we are not obligated to provide a refund. In jurisdictions that require a "cooling-off" period or otherwise mandate refunds, we will, of course, comply with those laws (for instance, certain regions allow you to cancel a digital service within 14 days of purchase, provided you haven't started using it – if applicable, details would be provided in the purchase flow).

Credit Expiration and Limits: Purchased credits do not expire for as long as your account remains active, except credits that are part of a monthly subscription plan may reset or expire as per the plan's terms (we will clearly inform you if, for example, monthly credits reset each billing cycle or roll over). If we ever decide to implement an expiration for credits (say, if inactive for a long period), we will clearly notify you in advance. If your account is terminated (by you or by us for cause), unused credits may be forfeited and not refundable.

Changes to Pricing: We may adjust pricing for our credits or subscriptions from time to time. If we do, and you are a subscriber, we will give you reasonable advance notice of any price change and the opportunity to cancel if you do not agree. Continued use of the Service after the price change goes into effect constitutes your agreement to pay the new rate. One-time credit purchases will always show you the current price, so only purchase if you agree to the price.

Promotions and Free Trials: We may occasionally offer promotional deals or free trial periods for premium features. These are subject to these Terms as well as any additional terms of the promotion. For example, a free trial may automatically convert to a paid subscription if not canceled before the trial ends – if so, we will make that clear in the offer details. Promotions can be limited-time and can be terminated or modified by us with or without notice, but changes won't affect you if you already redeemed a promotion in a way that impacts your usage (except in cases of abuse).

Taxes: Stated prices generally do not include taxes or duties that may apply. If any such taxes (like VAT, sales tax) are applicable to your purchase, we may charge them at checkout as required by law. You are responsible for any taxes that apply to your purchases.

Payment Issues: If we cannot charge your provided payment method (e.g., card expiration or insufficient funds), we may suspend or revoke your access to paid features. It is your responsibility to ensure your payment information is accurate and up to date. For subscriptions, if a payment fails, you should update your payment info promptly; we may attempt to retry the charge, but if it continues to fail, we may cancel your subscription.

Please use purchases wisely. Credits are intended for your personal/business use of Tryotic. Using them for any fraudulent purpose or reselling them is not allowed. If you encounter any issues with credits or billing, contact our support and we will do our best to resolve the issue.

5. Termination and Suspension of Account

By You: You have the right to stop using Tryotic at any time. You may delete the app from your device and, if you wish to permanently close your account, you can contact us to request account deletion (or use any self-service account deletion feature if available). Deleting your account will remove your access to the Service and may delete the content you have stored (as described in the Privacy Policy). Keep in mind that if you later decide to return, you might not be able to recover your old data.

By Us: We hope to have you as a user for a long time, but we reserve the right to suspend or terminate your access to Tryotic, at our discretion, for any reason. Typically, we will do so if: (a) you have violated these Terms (or we have a strong good faith belief that you have done so); (b) you are using the Service in a manner that could cause us legal liability or disrupt others' use of the Service; (c) we are required to do so to comply with a legal requirement or court order; or (d) we choose to discontinue the Service (in which case we will try to give you advance notice). In many cases of minor violations, we will attempt to send you a warning and/or temporarily suspend your account before terminating it, but we are not obligated to provide notice or an opportunity to cure. For serious violations or illegal activities, your account can be terminated or suspended immediately without notice.

If your account is terminated (by you or us), your right to access the Service ceases immediately. We will have no obligation to maintain any information or content in your account, or to forward any information to you or any third party. If we terminate for violation of Terms or illegal conduct, you are not entitled to any compensation or reimbursement for any unused credits or subscription time. If we terminate without cause (e.g., shutting down the app entirely), we will refund any prepaid, unused portion of your subscription or credits where feasible.

Effect of Termination: Upon termination, Sections of these Terms that by their nature should survive will continue to apply. This includes provisions on intellectual property, warranties disclaimer, limitation of liability, indemnity, and governing law. Termination of your account does not relieve you of any obligation to pay any outstanding fees or resolve any disputes.

We also reserve the right to deactivate and reclaim usernames that have been inactive for a very long time (for example, if an account hasn't been logged into for over a year), but we will try to notify you at your email before doing so.

6. Indemnification

You agree to indemnify and hold harmless AtikoLabs, its parent company, affiliates, officers, agents, employees, partners, and licensors ("Indemnified Parties") from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) that arise from or relate to: (a) your use or misuse of Tryotic, (b) your Content that you upload or create (including any claims that your content infringes or violates any third-party rights or laws), (c) your violation of these Terms, or (d) your violation of any law or regulation. This means you will defend (at our request), indemnify, and hold us harmless from any third-party claim or demand arising out of your actions in connection with Tryotic. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (at your expense), and you agree to cooperate with our defense of such claims. You shall not settle any such claim without our prior written consent unless it unconditionally releases the Indemnified Parties of all liability.

7. Disclaimers of Warranties

Tryotic is a cutting-edge service, but it has its limitations and is provided as-is. AtikoLabs provides the Service "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, we disclaim all warranties and conditions of any kind, whether express, implied, or statutory, regarding the Service. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no promises or guarantees that the Service will always be available, uninterrupted, secure, or error-free; that it will meet your expectations; or that any results (like the AI-generated images) will be accurate, reliable, or to your liking.

Use at Your Own Risk: You understand that using Tryotic involves the transmission of data over networks that we don't control (such as the internet and wireless networks), and thus we cannot guarantee absolute security. You also understand that AI-generated content might not be perfect – for example, the results may sometimes have artifacts or inaccuracies, or the Service might not always properly render your input (especially if the input doesn't meet our guidelines or the model's capabilities). You use the Service and rely on any output at your own discretion and risk. We are not responsible for any damage to your device or data loss that results from use of the app, and you should use your own security measures (like updated antivirus and device backups).

Some jurisdictions do not allow the disclaimer of certain warranties, so to the extent that they are legally not allowed to be disclaimed, those warranties are not disclaimed but rather limited to the shortest legally permissible period or smallest scope. No advice or information (whether oral or written) obtained from AtikoLabs or through the Service will create any warranty not expressly stated in these Terms.

8. Limitation of Liability

To the fullest extent permitted by law, in no event will AtikoLabs or its affiliates, or their respective officers, employees, agents, suppliers, or licensors, be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your access to or use of (or inability to use) Tryotic. This includes, without limitation, any damages for lost profits, lost data, loss of goodwill, device damage, or the cost of substitute services, even if we have been advised of the possibility of such damages.

To the extent permitted by law, the total liability of AtikoLabs for any claim arising out of or relating to these Terms or the Service is limited to the greater of: (a) the amount you have paid us in the 6 months immediately preceding the event giving rise to the claim (if any), or (b) USD $50.00. This means if you haven't paid anything, our liability is capped at $50. These limitations apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not we have been informed of the possibility of such damage.

Exceptions: Nothing in these Terms shall limit or exclude our liability for any liability that cannot be limited or excluded by law. For instance, some jurisdictions do not allow the exclusion of liability for personal injury or death caused by negligence, or for gross negligence or willful misconduct. Also, certain laws may not allow the exclusion of implied warranties or the exclusion/limitation of certain damages. In such cases, our liability will be limited to the minimum extent required by law.

You acknowledge and agree that the fees (if any) charged for Tryotic reflect this allocation of risk and the limitation of liability specified herein, and that we would not provide the Service without such limitations.

9. Miscellaneous Provisions

Governing Law: These Terms and any dispute arising out of or in connection with them or the Service shall be governed by and construed in accordance with the laws of Türkiye (without regard to its conflict of law principles). If you are a consumer in the EU, you may have additional protections under mandatory laws of your country of residence, which are not affected by this provision.

Jurisdiction and Venue: You agree that any dispute or claim arising out of or relating to these Terms or your use of Tryotic that cannot be resolved amicably shall be resolved exclusively in the courts of the courts of Istanbul, Türkiye, and you consent to personal jurisdiction in such courts. If you reside in a jurisdiction that does not allow you to consent to a court as the exclusive forum, this clause does not deprive you of any rights you may have to bring disputes in your home forum under mandatory law.

Dispute Resolution and Arbitration (Optional): At our sole discretion, we may require you to submit any disputes arising from the use of these Terms or Tryotic, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the the Istanbul Arbitration Centre (ISTAC). You agree that any claims will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of AtikoLabs.

Assignment: You may not assign or transfer these Terms (or any of your rights or obligations under them) without our prior written consent. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law or otherwise. These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

Entire Agreement: These Terms (along with the Privacy Policy and any additional guidelines or terms provided within the app for specific features) constitute the entire agreement between you and AtikoLabs regarding Tryotic, and supersede any prior agreements or understandings between us relating to the Service.

Changes to Terms: We may modify these Terms from time to time (for example, to reflect changes in our Service or for legal reasons). If we make a material change, we will notify you by posting the updated Terms in the app or through other communications. We will also update the "Last updated" date at the top. Changes cannot be retroactive. If you continue to use Tryotic after new Terms take effect, you will be deemed to have accepted the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.

Third-Party Software and Links: The Service may contain links to third-party websites or services (for example, a link to our social media page, or a resource for help) and may include components that are licensed from third parties. We have no control over third-party websites/content and are not responsible for their content, privacy policies, or practices. Accessing any third-party site is at your own risk. Similarly, any third-party software included in Tryotic (if any) is provided to you under the respective third-party terms.

Relationship: These Terms do not create any agency, partnership, joint venture, or employment relationship between you and AtikoLabs. You and we are independent contractors.
